This fundamental monograph comprehensively examines the institutional and regulatory framework of the right to personal data in the new era, characterized by the rapid development of digital transformation and artificial intelligence, machine learning, neural networks, and decentralized systems. The monograph provides a new doctrinal definition of the concept of personal data based on the principle of technological neutrality, and thoroughly elucidates the dynamic life cycle of the institution of “processing,” from the emergence of information to its complete destruction. The study analyzes the procedures for processing personal data within the Unified Interactive Public Services Portal and Electronic Government systems, as well as the legal status of subjects and operators. It also puts forward models for eliminating collisions in the legal and technical qualification of offenses in the information sphere committed in cyberspace, particularly cases of unlawful acquisition of personal data through phishing, social engineering, and unauthorized access, as well as gaps in criminal-law protection. At the same time, the author integrates into the field of science an entirely new “Cyberalogy” methodology and develops innovative legal guarantees for ensuring information sovereignty, the inviolability of information in algorithmic environments, and protection against cyber threats.
